BATLX Waiver & Release of Liability | Payment Authorization

Welcome to BATLX! We are excited you want to take your game to the next level. TRAINING/LEAGUE PLAY: Training & League play will be at your own risk. BATLX is not responsible for any injury during these events. RESCHEDULING (1on1 Sessions): If for any reason you need to reschedule your session we require 24 hrs notice. Please contact Kelly Brown via email kelly.brown@batlx.com or text 902-483-1943 to reschedule. There is a $25 fee for a no show or last minute cancellation. There will be no fee for last minute cancellation due to illness. PAYMENT ARRANGEMENT: The Client will pay agreed-upon price for services and/or consulting prior to the scheduled session. If a payment plan is needed, please contact Kelly Brown via email kelly.brown@batlx.com to setup. MODEL RELEASE: Client grants to BATLX and legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs/videos of the client, client's child or children, or in which client may be included for editorial, trade, advertising and other purposes, and in any other manner and medium; to alter the same without restriction and to copyright the same. The client hereby releases BATLX and legal representatives and assigns from all claims and liability relating to said photographs/videos. Please indicate in the comment section if you wish NOT to have your images posted on any social media platforms. EXHIBITION: The client grants BATLX permission to display selected images resulting from this agreement as an example of BATLX's work and releases all claims to profits that may arise from the use of images. ENTIRE AGREEMENT: This agreement contains the entire understanding between BATLX and the client. It supersedes all prior agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. If the parties want to waive one provision of this agreement, it does not mean that any other provision is also waived. This constitutes an order for the training session(s) with BATLX. This contract between BATLX and the client shall not become effective until it is signed and the initial amount due has been paid. At the time the contract takes effect, BATLX shall reserve the date and time agreed upon, and not make any other reservations or accept any other clients for said date and time. For this reason, in the event that the Client cancels the contract for any reason, all monies due/paid shall be retained by BATLX in order to offset its loss of business.

l fully understand and acknowledge that recreational and fitness activities have inherent risk, dangers, and hazards and such exists in my use of any equipment and my participation in these activities; (b) my participation in such activities and/or use of such equipment may result in injury or illness but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that, could cause serious disability; (c) these risks and dangers may be caused by the negligence of the representatives, employees, or volunteers of BATLX, the negligence of the participants, the negligence of others, accidents, breaches of contract, (d) by my participation in these activities and for use of equipment, I hereby assume all dangers and all responsibility for losses and/or whether caused in whole or in part by the negligence or the conduct of the representatives, employees, volunteers of The BATLX, or by any other person. l, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify BATLX and its representatives, employees and volunteers from any and all claims, actions or losses of bodily injury, property damage, wrongful death, losses of services or otherwise which may arise out of my use of any equipment or participation in these activities, I specifically understand that I am releasing, discharging, and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the representatives, employees, and volunteers of BATLX. I acknowledge the contagious nature of the Coronavirus/COVID-19. I further acknowledge that BATLX has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. I further acknowledge that BATLX can not guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, staff, and other clients and their families. I voluntarily seek services provided by BATLX or any other business using BATLX facilities and acknowledge that I am increasing my risk of exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending my appointment.
